ARTICLE 1 – IDENTIFICATION OF THE SELLER
These General Terms and Conditions of Sale (hereinafter "GTC") are those of SAS Maison Sibling, a simplified joint-stock company under French law, whose registered office is located at 34 Place du Général de Gaulle, Bureau 3, 59000 Lille, and registered with the Trade and Companies Register of Lille Métropole under number 992 324 582.
The official Maison Sibling online sales website can be accessed at the following address: https://www.maisonsibling.com/ (hereinafter the "Site").
ARTICLE 2 – ENTIRETY
These General Terms and Conditions constitute the entire agreement between the parties. By placing an order, the Buyer is deemed to have accepted them without reservation.
They apply to all sales concluded on the Site, excluding any other platform or sales channel.
Maison Sibling and the Buyer agree that these Terms and Conditions govern their relationship exclusively. The Seller reserves the right to modify these Terms and Conditions from time to time. The applicable Terms and Conditions are those in effect on the date of the order.
ARTICLE 3 – CONTENT OF THE TERMS AND CONDITIONS
These Terms and Conditions of Sale define the rights and obligations of the parties within the framework of the online sale of products offered by Maison Sibling on the Website. The Buyer confirms having read and accepted these Terms and Conditions of Sale at the time of placing their order.
ARTICLE 4 – PRE-CONTRACTUAL INFORMATION
The Buyer acknowledges having received the following information prior to placing their order:
- The essential characteristics of the Products;
- Their price and associated delivery costs;
- The estimated delivery time;
- The terms of payment, delivery and execution;
- The conditions for return, refund and related limitations.
ARTICLE 5 – ORDERS
Any order placed on the Site constitutes express and unreserved acceptance of these General Terms and Conditions of Sale.
The ordering process includes the following steps:
- Product Selection;
- Checking the shopping cart;
- Customer identification or switching to guest mode;
- Validation of information (delivery address, billing address, delivery costs and total price);
- Final order confirmation and payment.
Maison Sibling limits purchase quantities to a maximum of five (5) identical products per order and to a total of seven (7) items per order, for logistical and environmental reasons.
In the event of exceeding these thresholds or suspicion of resale for commercial purposes, Maison Sibling reserves the right to cancel the order.
Similarly, Maison Sibling reserves the right to cancel or refuse any order that appears to be an anomaly or fraudulent, without incurring any liability in this regard. This decision may be based, in particular, on the detection of inconsistent information, a payment incident, suspected identity theft, or, more generally, any behavior likely to harm the interests of Maison Sibling.
In the event of cancellation after payment has been received, the full amount of the order will be refunded to the Customer.
ARTICLE 6 – PRE-ORDERS
Maison Sibling occasionally offers pre-order campaigns for certain popular products. These campaigns are time-limited and subject to a minimum order target to trigger production.
By placing a pre-order, the Buyer accepts the risk that the campaign may be cancelled if the funding goal is not reached. In the event of cancellation, the Buyer will be refunded within fourteen (14) days of the cancellation decision.
The Buyer agrees to wait for the estimated production time of a minimum of two (2) months, which may be extended in exceptional circumstances (including periods of high activity or end-of-year holidays).
ARTICLE 7 – “SHARE EXPERIENCE” PROGRAMME
Maison Sibling offers an exclusive program called "Shared Experience," which allows customers to receive pins after purchasing two compatible items. For each item purchased through this program, the customer receives an exclusive Maison Sibling pin, up to a limit of two pins per order.
In the event of a partial return (only one of the two items), the Buyer must return all brooches associated with the order. Brooches not returned will be charged fifty (50) euros each.
In the event of a complete return of the program (both items), the pins must also be returned intact and unused in order for the refund to be issued.
ARTICLE 8 – RETURNS AND REFUNDS
Returns are accepted subject to strict compliance with the following conditions.
Return shipping costs are the responsibility of the Buyer and vary according to the geographical area of shipment: ten (10) euros for any return made from metropolitan France, and twenty (20) euros for any return made from a country of the European Union.
The Buyer must first complete a return form available on the Website, specifying the items concerned and, if applicable, the reason for the return. Once the form is validated, Maison Sibling will provide the Buyer with the necessary instructions to proceed with the return, in accordance with the terms and conditions of the designated carrier.
Items must be returned within fourteen (14) calendar days of receipt, under the following conditions: items must be intact, unworn, undamaged, and accompanied by their original packaging, including labels and accessories; the return must be made in the original shipping carton, unless it is damaged.
Any item not meeting these conditions will not be eligible for a refund and will be returned to the Buyer. No exchanges are offered.
Subject to compliance with the aforementioned conditions, Maison Sibling will refund the returned item(s), less the return shipping costs mentioned above, within a maximum of fourteen (14) days from receipt and verification of the returned item(s). In the event of a complete order return, any initial shipping costs paid at the time of the order will also be refunded to the Buyer, in accordance with applicable law.
ARTICLE 9 – DELIVERY
Shipping costs are the responsibility of the Buyer and are calculated at the time of order. Maison Sibling cannot be held liable for delays caused by carriers or incorrect information provided by the Buyer.
ARTICLE 10 – LEGAL GUARANTEES AND NON-CONFORMITY
Products sold by Maison Sibling are covered by the following legal guarantees, in accordance with the French Consumer Code and Civil Code:
- the legal guarantee of conformity (articles L.217-3 to L.217-17 of the Consumer Code), and
- the legal guarantee against hidden defects (articles 1641 to 1649 of the Civil Code).
These warranties apply to the exclusion of any other commercial warranty.
10.1 – Legal guarantee of conformity
In accordance with Article L.217-3 of the Consumer Code, Maison Sibling is required to deliver a Product that conforms to the contract and is free from any defects of conformity at the time of delivery.
A product is compliant if it is:
- fit for the purpose normally expected of a similar product,
- and if it corresponds to the description, quality and presentation appearing on the Site at the time of sale.
The Buyer has a period of two (2) years from the delivery of the Product to act under the legal guarantee of conformity.
Any defects in conformity appearing within twenty-four (24) months of delivery are presumed to have existed at the time of delivery, unless proven otherwise.
Under this guarantee, Maison Sibling undertakes, at the Buyer's option:
- either to repair or replace the Product with an identical or equivalent item, depending on available stock and production costs,
- either to refund the price of the Product, subject to its prior return in its original condition.
All claims under the legal guarantee of conformity must be addressed to:
- via the contact form available on the Site; or
- by email to contact@maisonsibling.com.
In the event of non-conformity recognized by the Maison Sibling quality team, the Buyer will be asked to return the Product to the address indicated by customer service (a return label will be provided).
The return costs incurred in this context are covered by Maison Sibling.
Any Product repaired under the legal guarantee of conformity benefits from a six (6) month warranty extension.
10.2 – Legal guarantee against hidden defects
In accordance with Article 1641 of the Civil Code, Maison Sibling undertakes to deliver Products free from hidden defects which would render them unfit for the use for which they are intended, or which would diminish this use to such an extent that the Buyer would not have acquired them, or would have given only a lower price, if he had known of them.
The Buyer has a period of twenty-four (24) months from the discovery of the defect to take action on this basis.
In the event of a proven hidden defect, the Buyer may choose:
- either the cancellation of the sale and a full refund of the price of the returned Product,
- either a reduction in the selling price while retaining the Product.
10.3 – Warranty Limitations and Exclusions
The following are not covered by legal guarantees (this list is not exhaustive):
- Damage resulting from improper or intensive use of the Product;
- Any modification, repair, customization or alteration of the Product by the Buyer or an unauthorized third party;
- Damage caused by inappropriate conditions: exposure to excessive heat, direct sunlight, humidity, contact with liquids, rain, chemicals or food;
- Stains, tears, wear and tear or deformations resulting from normal use of the Product or from transport;
- Failure to comply with the maintenance and/or cleaning instructions provided by Maison Sibling;
- Products whose original labels, accessories or packaging have been removed or damaged.
Similarly, the natural characteristics of the materials used—such as variations in texture, weave, color, or inherent markings—are inherent to the very nature of textiles and the manufacturing processes employed. They cannot be considered defects of conformity or hidden flaws.
10.4 – Return conditions under warranty
Any product returned under the legal guarantee must be:
- clean, complete, and in a condition allowing for technical expertise;
- accompanied by the corresponding proof of purchase (invoice or order confirmation);
- sent according to the terms specified by Maison Sibling customer service.
Products that are subject to an assessment that does not conform to the criteria of legal guarantees may be returned to the Buyer, with the return shipping costs remaining at their expense.
10.5 – Final Provisions
The exercise of the legal guarantee of conformity or of hidden defects is free for the buyer.
These guarantees apply independently of any other commercial guarantee that may be granted by Maison Sibling.
The provisions of this article do not deprive the Buyer of the rights recognized by applicable law.
